Camper van Hire Policy | Rental Agreement
This agreement is made between Camper van Hire North Wales Limited, whose registered address is 4 Whitefield Paddock, Bagillt, CH6 6AR and the person(s) signing their acceptance of the terms within.
Please read through all the terms and conditions carefully. You can contact us in relation to this hire policy by writing to us at the above address
Terminology A ‘rental agreement’ is the document read and signed by the customer on collection and return of the company’s vehicle. Signing the rental agreement document forms a contract between the customer and Camper Van Hire North Wales Ltd. This document includes wording as ‘you’, ‘your’, ‘hirer’, ‘driver(s)’, ‘yourself’ which refers to the person or people hiring the campervan. The campervan or ‘vehicle’ means the vehicle under hire and includes the engine, tyres, accessories, living equipment, bed, seats, and any other specific equipment.
Hire Bookings are a minimum of two nights. On completion of signature of the rental agreement, and bank transfer of a sum of £1000 by means of security deposit the terms and conditions will also be agreed.
The deposit payment confirms your acceptance to hire our vehicle which will be covered by our specified insurers, and upon receipt of emailed confirmation from us this contract shall have effect.
Vehicles will not be released until full payments are made.
And as such you agree to pay Camper Van North Wales Limited any additional costs over and above the £1000 security deposit value should damage exceed this amount within 28 days of your hire. You irrevocably authorise Camper Van North Wales Limited to deduct from the security deposit amounts due to Camper Van North Wales Limited arising out of this agreement. Security deposits will be refunded within 48 hours of return of the hired vehicle, providing that the vehicle is returned in the same condition that it was hired in. You will be given an opportunity at the beginning of the hire to confirm the state of the vehicle to which returned condition will be expected.
Payment is only accepted by bank transfer.
All rights are reserved by us to refuse any hire if in our reasonable opinion you are not suitable to take possession of the vehicle and we do not need to state the reason for this.
We take no responsibility for any detention, delay, loss, damage that you might experience, unless caused by our negligence. You will be shown how to use the vehicle and what expectations that we have as to its intended use. All drivers must be present for collection of the campervan. No exceptions can be made. All drivers must provide two separate forms of proof of address dated within 90 days of the hire period, present a photo card driving licence,
DVLA check code and sign this agreement on collection of the vehicle otherwise hire will be invalidated.
Insurance
Camper Van North Wales Limited provides fully comprehensive insurance to those named on the rental agreement only and those named are the only people insured to drive the vehicle. A picture copy of both sides of your driver’s licence will need to be sent to our company email address (campervanhirenorthwales@gmail.com) at least 7 days before your hire period, as well as a DVLA check code.
By signing this agreement, you are also confirming that you will have answered the questions truthfully, supplying all required information.
Driving Licence, Health & History
Drivers must be over 25 years of age and under 69, in good health and hold a UK driving licence.
Drivers should have no mental or physical disabilities which would interfere with their ability to drive, for example stroke/deafness/heart condition/diabetes/loss of limb/loss of sight in an eye/epilepsy. In addition, you must not be taking drugs likely to affect your driving or drugs prescribed by a registered medical practitioner for treatment of drug addiction.
You will need to have held a UK driving licence for at least 2 years. We will require the driving licence numbers and other identification information for all those who intend to drive, when a booking is made.
We will need to see the driving licences for all named drivers, plus two other forms of proof of address for example-

An annual council tax bill will be accepted. All other documents must be dated within
90 days of the hire date. The address & name on your licence must match both
documents.

All proof of address must be dated within 90 days of the/your hire period, and must be presented prior to the collection of the vehicle. These must be original documents or photo cards. Both proof of address’ must have the same address as presented on the driving licence. A DVLA check code will also be required, a link has been provided on our website.
The vehicle must only be driven by you or any other person who has been authorised by us, for whom you have provided the driving licence and personal identification information. Failure to provide accurate information may invalidate the insurance and render you liable for all losses however sustained, including claims by third parties. The rental agreement will be held for up to 2 years following the hire period. You warrant that all information supplied to us in relation to this agreement is true and complete. You must also inform us of any changes from the point of booking up until after the return of the vehicle, including but not limited to the number of points on a driver’s licence. You must not drive the vehicle whilst under the influence of alcohol or drugs or on any medication that advises against or that causes drowsiness. You agree to return the vehicle to us in the same condition as you rented it, subject to expected wear and tear, with the same documents, parts and accessories, at the location and on the date and time agreed. Failure to do so may result in further charges applied.
Collection & Return
Collection time is between 14:00 and 15:00 on the date of hire. Exact time will be provided at the point of booking. Return time is between 10:00 am and 11:00 am. On arrival of collecting the hire van please ensure you allow at least half an hour for us to show you around the van, go through the specifics of how to operate all the features within the van and describe how the vehicle is to be used. We may also need to go through any last-minute paperwork. Vehicles are to be returned within the agreed time and can only be returned outside our normal business hours via prior agreement with us. No refund is given for early return of the vehicle.
At Camper Van North Wales Limited we make every effort to ensure that your campervan is ready for collection on time, however, during busy periods, there may be some delays which are out of our control.
Please check the times for collection and return carefully. If a vehicle is not returned by the time shown on the rental agreement, a charge of £50 for each hour, or part thereof, will apply. Should the late return of the vehicle make us liable for any extra costs (such as compensation for the next hirer), we reserve the right to request reimbursement of these costs from you. Please return your vehicle on time.
Booking Confirmation and Advance Payments
A non-refundable booking deposit of £150.00 per week's (or part week's) hire must be paid for each booking unless otherwise agreed with Camper van hire north wales ltd. The booking deposit is not refundable under any circumstances, and shall be deducted from the hire charges. The balance of the hire charge (less the booking deposit) is payable six weeks prior to the commencement of the agreed hire period. In the event that a booking is made within 6 weeks of the hire period, final payment will be due at the time of booking. In the event that monies are not paid and cancellation subsequently follows, full hire charges will still become due. Deposits paid are only valid toward the dates requested at the time of booking, and are not able to be commuted to any other date.
Confirmation of the booking details will be emailed to you after the deposit has been paid. Until a deposit payment has been made, your booking may not be confirmed. Our invoice will constitute our final confirmation.
Vehicles will not be released until full payments are made.
Cancellations
In the event of cancellation by you:
All cancellations must be notified to Camper Van Hire North Wales Ltd in writing. All deposits paid are non-refundable, unless the Company cannot supply your requested vehicle. Please note that your booking deposit is not refundable beyond the cooling off period of 7 days from when it is paid (Distance Selling Regulations).
If you are unable to attend your chosen dates of hire, for example owing to illness or other travel concerns, Camper van hire north wales are under no obligation to commute your hire and hire fees to another date. Note that if the reason for cancellation is covered under the terms of your travel insurance policy, you may be able to reclaim these charges. We strongly recommend that you take out separate travel insurance. It is your responsibility to ensure that the travel insurance you purchase is adequate for your particular needs.
In the event of cancellation by Camper Van Hire North Wales Ltd:
Camper Van Hire North Wales Ltd's liability is strictly limited to a full refund of all monies paid by you. We accept no liability for the cost of a replacement vehicle, travel expenses or any other subsequent loss. (Circumstances that we deem to be out of our control include - but are not limited to - vehicle breakdown, damage sustained to the vehicle and late returns by a previous hirer). We recommend that you also have current travel insurance.
Adverse Weather:
In the event of RED weather warnings, snow or particularly hazardous driving conditions forecast 3 days either side of collection day, the Company also reserve the right to cancel the hire. Hirers may then commute the hire to another date up to a maximum of 30 days from the original date, and are advised to have travel insurance in place should they instead wish to claim for hire fees paid.
Camper Van Hire North Wales Ltd reserve the right from time to time to vary the hire rates on the website, terms and conditions of hire, and to refuse to hire to any person at the Company's discretion. We reserve the right to cancel the Hire in the event of invalid driving licences, incorrect information supplied on booking forms, customer ID requested not supplied or correct on collection day, or if our Terms and Conditions are not met. The cost of the Hire will not be refunded in this instance.
Hirer Obligations
By signing the rental agreement, you agree that you will:
Return the Vehicle to Camper Van Hire North Wales Ltd in the same condition as it was received - ordinary wear and tear excepted - on the due date and time specified;
Not use the Vehicle for hire or reward, nor use it in violation of any law, ordinance or regulation, nor remove it (without prior written consent of Camper Van Hire North Wales Ltd) from the UK mainland.
Limit the mileage to 1000 miles per week of hire (pro rata), thereafter subject to a 50p/mile surcharge.
Not carry more passengers than the seating capacity of the vehicle, or allow the vehicle to be overloaded;
Maintain at all times the correct level of engine oil and coolant (where applicable). Failure to do so may result in engine damage, for which the Hirer will be fully responsible;
Be responsible for the Additional Charges set out below;
Further protect the interests of the Insurer and Camper Van Hire North Wales Ltd by ensuring the vehicle is always parked as safely as possible, locked when unattended, and the keys are secure;
Authorise Camper Van Hire North Wales Ltd to verify through credit agencies, the DVLA or any other sources - personal, driving and credit information provided by hirer and any additional drivers;
Not operate the Vehicle, or permit the Vehicle to be operated in, any way that would violate this contract - including, but not limited to:
Any person under 25 or over 75 years of age driving the vehicle;
Driving in motor sport events (including racing, pace making, rallying, reliability trials, and speed testing);
Being used to propel or tow any vehicle or trailer;
Any person driving the vehicle when unfit through drink or drugs or with blood alcohol concentration above the limit prescribed for the time being by road traffic legislation;
By any other person other than the hirer or additional Driver(s using the vehicle);
Using the vehicle under authority of any licence other than his own;
If you or any driver leaves the car unlocked or fails to secure the keys;
In a reckless or imprudent manner or if the vehicle is deliberately damaged.
Additional Charges and Liabilities
In addition to the agreed rental rate, you may become liable for the following charges:
All fines and court costs for parking, traffic or other legal violations assessed against the Vehicle whilst the vehicle is under your control. You are liable as if the owner of the vehicle in respect of:
Any fixed penalty offence committed in respect of that Vehicle under the Road Traffic Act 1988 and Road Traffic Offenders Act 1988; any excess parking charge which may be incurred in respect of that Vehicle in pursuance of an Order under Sections 45 and 46 of the Road Traffic Regulation Act 1984 or the Road Traffic Act 1991 during the period of hire.
Any uninsurable damages - including wheel & tyre damage, windscreen damage, and any internal damages or breakages - howsoever caused;
A £75.00 charge in the event that the vehicle is returned to us with a toilet cassette which has not been suitably emptied and cleaned;
A £500 charge in the event that the vehicle smells of tobacco smoke; If damage including ash or burns occur, this additional repair cost will be individually charged.
An administration charge of £20.00 plus the cost of the missing fuel will be charged to return fuel level to that marked on the check out sheet at the commencement of hire, in the event that you fail to refuel the vehicle (NB there is a petrol station in our village);
A cleaning charge of up to £150.00 in the event that the vehicle is not returned in a similar condition in which it was rented out;
A charge of £75.00 in the event that the Tracker device fitted to the vehicle indicates that the vehicle has exceeded a sustained speed of 80mph. (This is to attempt to ensure hirer and passenger safety, as camper vans and motorhomes are unstable over these speeds);
A call out charge for damage repairs / loss of camper keys of £60.00, plus mileage each way at £0.50 per mile and the cost of parts / keys / recoding etc. Our time on site and repair work is also charged at £35 per hour. These values are plus VAT. This charge will also apply if we have to attend the vehicle to further explain or check items which are working as they should (a full pre-hire briefing is given, and an instruction manual provided).
In the event that items are missing from the inventory, a charge to replace missing items will be made;
An insurance policy excess charge of £1000.00 for each incident claimed on the motor insurance policy, if the cost of the claim is expected to exceed this amount. If the claim cost is less than the policy excess, you will be liable for the full claims costs. In the event of Campervan hire north wales Ltd receiving from the third party any part of the amount to reimburse the policy excess payment made and provided you have performed your obligations hereunder, Camper Van Hire North Wales Ltd shall repay to the hirer the like part of such excess;
General internal and bodywork damage will be charged out at cost plus an Administration Charge of 10% of the total costs associated with the repair costs (to cover ordering and collecting parts, obtaining quotes for repairs, delivering vehicles for repair, invoicing);
If, due to gross negligence (such as, but not limited to: driving through flood water, driving into an overhead object), it is necessary for the vehicle to undergo repairs, you may additionally be liable for the full cost of repairing damage to the actual Vehicle supplied, administrative fees, plus loss of revenue at the prevailing daily rate (up to the value of one month's full rate hire of the vehicle). Camper Van Hire North Wales Ltd has the sole right and responsibility to repair the Vehicle. Damage should be reported to the office as soon as possible and in any event within 24 hours after the Vehicle was damaged;
In the event of the theft of the vehicle owing to your negligence (such as leaving it unsecured, or through loss of keys), we may hold you responsible for the loss of the vehicle, plus you will also be charged the excess, administrative fees plus loss of revenue at the prevailing daily hire rate (up to the value of one month's full rate hire of the vehicle) following the incident. If the vehicle is stolen, it should be reported immediately, and in any event within 24 hours, after the Vehicle was stolen. It should also be reported to the Police immediately and a crime reference number should also be obtained;
Any costs, including reasonable legal fees where permitted by law, incurred collecting payments due from hirer hereunder.
In the event that full payment is not made after 28 days of invoice, a reminder will be sent, 14 days thereafter the account will be passed to our collections agency incurring an extra charge of 15 % (+VAT) of the total balance due. You agree as part of this contract to pay this sum which represents our reasonable costs in collecting the unpaid amounts.
All charges are subject to final audit.
You agree to allow Camper Van Hire North Wales Ltd to compute and debit final charges from Credit/Debit Card, if that is the form of payment used by you.
If you seriously breach this agreement, or seriously damage the vehicle, you agree to cease using the Vehicle and to pay all expenses incurred in returning Vehicle to the collection point of rental.
Insurance / Eligibility
Fully Comprehensive insurance is included within the stated hire charge. You are advised to also take out additional personal holiday insurance.
The vehicle is insured for the contracted period of hire ONLY. You must therefore notify Camper Van Hire North Wales Ltd in the event that the vehicle will be returned late. Failure to do this may result in the vehicle not being insured for your use and may incur a traffic offence under the Road Traffic Act.
An insurance policy excess of £1000 is payable by you for each incident claimed against the insurance policy, where it be for vehicle damage, fire damage or the theft of the vehicle. This applies to all vehicles if the cost of repairing damages in relation to any given incident should exceed the excess amount. Should repairs cost less than the insurance excess amount, they will be charged to the Hirer at cost plus the Admin Charge - to cover items such as driving to obtain quotes, collecting repair parts. See Overhead Objects and Flooding for exclusions.
Camper Van Hire North Wales Ltd reserve the right to charge any amount up to the insurance excess along with any associated costs against the drivers' or hirers' security deposit provided.
Accepting these Terms indicates authorisation to Camper Van Hire North Wales Ltd to be able follow this process if required.
Drivers must be over the age of 25 and under the age of 75, in good health, and must have held a full UK driving licence for a minimum of 2 years. (Aged 27 or over and 5 years licence). Drivers from overseas must produce a valid Licence for their country of origin. Driving convictions may result in additional charges or insurance may not be accepted, it is the hirer's responsibility to make Camper Van Hire North Wales Ltd aware of such a minimum of 6 weeks prior to the hire date, via the Insurance eligibility checker. We regret that we are unable to insure unemployed persons, undergraduates, or scrap metal merchants.
No one other than the drivers named in the insurance proposal form may drive the vehicle.
Overhead Objects and Flooding
All drivers must be aware of the unusually high nature of these vehicles when driving under low bridges, canopies, car parks etc. The headroom clearance is usually stated within the driver's field of vision. Drivers are also not permitted to take vehicles through road flood water under any circumstances. Damage to the vehicle caused through road flood water or collision with an overhead object (any damage above a height of 6') is classed as negligence - as such the insurance excess will be deemed to not apply - and repairs and any costs arising (ie: cancellation of subsequent hires up to a period of one month) will be charged in full to the Hirer.
Fixed Penalty Notices
In the event that a fixed penalty notice is received for parking, non payment of toll charges, or a road traffic offence, the driver's details will be provided to the relevant authority and we will issue you an administrative charge of £10 plus VAT.
Accident Procedure
You shall, in the event of an incident that results in damage to the Vehicle, ensure that:
The driver of the Vehicle completes and delivers to Camper Van Hire North Wales Ltd the relevant accident report and photos within 48 hours after the end of the hire period.
No admission of liability is made to any person in relation to such accident;
Any writ of summons, summons or other document relating to any proceeding arising out of such accident is forthwith delivered to Camper Van Hire North Wales Ltd at the address on the motor rental agreement;
All assistance is rendered to Camper Van Hire North Wales Ltd and its insurers to the conduct of such proceedings including without prejudice to the generality of the foregoing permitting such proceedings to be brought by Camper Van Hire North Wales Ltd in the name of the hirer and defending any proceedings brought against the hirer;
You shall pay or reimburse Camper Van Hire North Wales Ltd against all losses, liabilities, costs, actions, claims or demands which it may incur or have brought or made against it in relation to the Vehicle or its use and which are not recoverable under a policy of insurance whether the same is effected by Camper Van Hire North Wales Ltd or hirer;
The names and addresses of all witnesses thereto are collected and given to Camper Van Hire North Wales Ltd .
You must report any traffic accidents to us and also the police, reporting any damage. You must not admit fault or settle any claims yourself. If possible, please take names, registration numbers and insurance details of the other party involved in the accident. Please note the exact time of the accident and location and where possible. Please take photographs of the scene. Ensure that you are in a safe position and do not move the vehicle unless you have been informed by us and the police that it is safe to do so. If the campervan is vandalised or scratched, please note times observed and take photographs of where it happened if known. This also must be reported to Camper van hire north wales Ltd immediately. Camper van hire north wales Ltd will endeavour to ensure that any money due back to you is released as quickly as possible, however third-party claims can take varying amounts of time to resolve. Camper van hire north wales Ltd cannot quicken up the process as the handling of these claims is left up to Camper van hire north wales Ltd’s insurers. Camper van hire north wales Ltd is entitled to withhold the security deposit, until your liability and the amount of damage or loss has been finally determined.
Cleaning
Should the vehicle return and require more than our standard cleaning procedure you will be charged these additional costs to restore the vehicle to its pre-rental condition and may incur a deep cleaning charge of £150.00. If any damage occurs to the upholstery or the need for deep cleaning due to heavy soilage, this will also incur a charge which will be individually evaluated.
Extras
We can provide extras, as detailed on the booking form, and these are priced accordingly. If these items are missing or damaged, we also have the right to charge you for replacements.
Engine Care
If any damage to the engine is caused by customer’s own actions, you will be liable for the cost of repair. This would include putting incorrect fuel into vehicle or driving too hard putting the engine under extreme load, driving too fast or ignoring warning lights. You are expected to take all reasonable steps to properly maintain the vehicle including checking tyre pressures and batteries every 500 miles. You must report to Camper Van Hire North Wales Ltd as soon as possible if a warning indication light is illuminated. You agree to maintain the Vehicle to these conditions and acknowledge that any mechanical damage occurred as a result of your failure to maintain the vehicle in accordance with this clause must be paid by the hirer
Wheels/Tyres
You will ensure that the tyres are not damaged before hire and ensure that the wear is legal. During your hire period, if tyres and/or wheels are damaged, the cost for refurbishment will be required.
Health & Safety
You must follow the health and safety guidelines when operating and using any equipment in the campervan. The guidelines can be found on campervan hire north wales website www.campervanhirenorthwales.co.uk.
Use of Appliances
Please use caution when using appliances. Please ensure that the gas cylinder is attached correctly, as shown, and that the gas is turned off when not in use. The renter must not leave naked flames including the hob unattended when on. You must also ensure that the diesel heater, all appliances, the pump and the gas cylinder are turned off when driving and that the front swivel seat is turned in the correct position before travelling, this includes driving on private land such as campsites and if these conditions are breached, we will not be held responsible for any injury caused. The hirer must also ensure that the roof is secured before driving, this also includes driving on private land. Any damage caused as a result of not following these guidelines will be classed as negligence and you will be liable for repair costs involved.
Seat Belts, Boosters & Baby Seats
The bed system has Isofix provided, however, we do not take responsibility with how the car seats are fitted into the vehicle. You can obtain advice on correct fitting from your car seat provider. You are legally responsible for ensuring that appropriate car seats are used.
Extent of Hire
The vans can be driven anywhere in the UK including Wales & Scotland. A period of hire cannot exceed three months. In the case of winter hire, Camper van hire north wales Limited cannot be held responsible in the event of any damage or inconveniences caused by freezing conditions. This is the responsibility of the hirer.
Prohibited use of Hire
Prohibited use of the vehicle is based on both the safety of the hirers and the preservation of our campervans. Prohibited use includes, but may not be limited to:
• For carrying persons for hire, gain or reward.
• To carry any inflammable, explosive or corrosive materials.
• For using the vehicle for a purpose of which it is not designed including racing or driving in a dangerous or reckless manner.
• For carrying illegal substances or product either for commercial purposes, financial gain, or delivery of such goods.
• For driving the vehicle in an unsafe manner or on a unroadworthy condition. • For driving the vehicle on unsealed and non-public roads.
• Leaving with the ignition key in or on the vehicle or unlocked while it is unoccupied.
• Submersion in water or in contact with saltwater. If the vehicle is used as above, you have breached the terms and conditions of hire and are liable for costs involved to repair or replace the campervan.
Mileage
Mileage limited to 800 miles for up to 7-night.
Fuel
On collection the fuel tank will be full and must be returned to us full. An administration charge of £20.00 plus the cost of the missing fuel will be charged to you or invoiced if the van is missing fuel. The vehicle is diesel. Your security deposit will be used to re-fuel the vehicle if required.
Use of Barbecues
You can use a barbecue if this is agreed by the site or land at which you are staying, however, please keep at a distance of 3 metres from the van or awning when used and dispose of the barbecue correctly.
Smoking
Smoking, including E cigarettes/vapers, is strictly prohibited in or within 5 metres of the Campervan Hire North Wales Limited vehicles and a penalty fee of £500.00 will be imposed for smoking inside the vehicle to cover the costs of sanitizing and cleaning. If damage including ash or burns occur, this additional repair cost will be individually charged.
Drinking Water We will not be responsible for the cleanliness of drinking water obtained from campsites. The water stored in the van is not drinking water therefore we strongly suggest that you drink bottled water.
Keys
If the vehicles keys are lost or damaged you will be liable for the costs of replacing the keys and any cost associated with getting a new set of keys to you during your hire period.
Your Car / Parking at our base
The hirer may park one vehicle free of charge and at his/her own risk for the period of the hire. we do not take any responsibility for loss of or damage to your car. You may also be liable for informing your insurance company of your vehicle’s location
Breakdowns
Camper Van Hire North Wales Ltd provides a 24 hour Recovery Services in the event of a breakdown, we will advise you of this procedure when you collect the van. A full Breakdown Relay service is provided if the vehicle cannot be repaired by the roadside.
Whilst we make every effort to ensure our vehicles are in full working order - we will not accept liability for consequential losses or claims arising from breakdown, accident or other cause. We will, however, offer a refund if you are not found to be at fault.
During a breakdown or loss of use of the campervan, our liability extends to refunding your hire charge for any days you lose the total use of the vehicle. If the breakdown is caused by negligence, you will be responsible for any recovery costs or repairs incurred and you will not be refunded for the hire time lost.
If the campervan must be recovered, you must hand over the keys to the recovery driver and not abandon the campervan. If you abandon the camper, you will be liable for the costs of getting the vehicle back to Camper van hire north wales Ltd plus any damage caused to the van as a result of being left.
Your Liabilities
You are personally responsible for speeding fines, parking tickets etc. if incurred during your hire period. You will also be liable for damage caused to third parties as a result of negligence. This includes if a cycle rack or awning damages a third party or their property.
You must use the campervan and its contents in the way explained to you or as explained on our website. You must use the campervan and its contents responsibly and must follow instructions given, where instructions are not provided, you must assume that ‘normal’ and ‘common sense’ rules apply. You must only carry passengers that have allocated seatbelts. If additional passengers travel in the campervan, you will have breached the terms and conditions and we do not take responsibility for any accidents or injury caused as a result of this malpractice or rental period of hire lost as a result. If there is damage caused to external parts including awnings or rails as a result of negligence, you will be liable for the cost of replacement. If these are damaged as a result of an accident, it must be reported to us at the time and again times noted, and photographs taken. If no direct instructions are given, it is assumed that ‘common sense’ is used, however, you can access advice and support at any time if you are unsure how to use an item. It is expected that you do not operate equipment until you have checked how to use it. You must operate the raising of the roof or bed particularly as shown and in line with supporting information given. You are liable for damage above cab height. You are fully responsible for damage caused by failure to assess the height of the van and striking overhanging objects and subsequent damage to third parties and their property. You have a duty to report any damage to Camper Van Hire North Wales Ltd. This also includes any damage of the undercarriage of the vehicle and is classed as gross negligence. In these cases, you shall be liable for the full amount of damages. You shall be liable to Camper Van Hire North Wales Ltd for an amount commensurate to the severity of the negligence, up to and including the full amount of the loss. The burden of proof that negligence has not occurred lies with the hirer
Our Liability
We are only liable for any loss or damage suffered by you or member of your party if loss or damage is due to our negligence. This will be explained to you prior to hire as part of the insurance. Subject to our obligation to deliver the vehicle, campervan or an appropriate substitute vehicle, you release us, from any liability to you (regardless of who is at fault) for any loss or damage incurred by you by reason of this agreement, including but not limited to: • Any loss or damage caused by breakdown, mechanical defect, accident or the vehicle being unsuitable for your purpose.
• Any loss or damage to any property left in or on the campervan,
• Subject to any insurance arrangements agreed with us, you agree to indemnify and keep indemnified us, our employees and agents against any claims, demands and expenses (including legal costs) incurred or sustained by us by reason of your use and/or possession of the campervan.
Breaches of terms and conditions
If you breach the terms and conditions as set out above, we have the right to cancel your booking without notification If you are already in the van, we may require you to leave the van immediately. If you breach the terms of conditions, you will not be refunded for your hire period and you will be liable for costs incurred in returning the campervan to us.
Data Protection
For the purposes of the Data Protection Act 1984, Camper Van Hire North Wales Ltd or any subsidiary of Camper Van Hire North Wales Ltd may hold and process by computer or otherwise the information given to Camper Van Hire North Wales Ltd by the hirer or any Additional Driver to identify other products or services which might be relevant and for statistical analysis.
Personal Information supplied will be disclosed to a third party for identity validation purposes subject to a Data Protection Act request.
The vehicle is fitted with a Tracker device. Camper Van Hire North Wales Ltd will view the information recorded by Tracker in the event that the vehicle is not returned at the designated time, in the event that the vehicle is returned with damage, or in the event that the Tracker system notifies that the vehicle has been exceeding a sustained speed of 70mph. We will only share identity information with our insurance company as required. A copy of our privacy policy is available on request.
